Unfortunately arbitration is often almost as complex and costly as a trial. Mediation has become a favoured option enabling the parties to find a reasonable solution in the large majority of cases. (About 80% of cases that go to mediation reach a settlement.)
Sometimes disputes may arise during the course of a construction contract. Discussions between architects, builders, sub-contractors and customers can break down escalating the problem and sowing the seeds of lengthy and expensive litigation at a later stage. Mediation can be helpful to resolve issues long before the litigation stage.
The mediation techniques used are similar for all types of dispute, but it helps to have a mediator who knows the difference between a rafter and a purlin.
